RULES OF THE CHALLENGE « EXCESS CHALLENGE – SPEED »

 

ARTICLE 1. ORGANISATION OF THE CHALLENGE

The company MY BOAT SOLUTIONS, SAS with a share capital of €1,225,000, registered under RCS n°833 958 333, Immeuble Zero Newton, 3 Place Albert Camus, 44300 Nantes (hereinafter the « Organiser ») organises a free game with no purchase necessary, entitled « EXCESS CHALLENGE – SPEED » (hereinafter the « Challenge »).

ARTICLE 2. NATURE OF THE CHALLENGE

The Challenge is based exclusively on a performance mechanism, through the achievement of measurable objectives via the Seanapps mobile application, with no draw. Winners are designated on the basis of a ranking established according to objective criteria, automatically measured by the application.

ARTICLE 3. CONDITIONS OF PARTICIPATION

Participation in the Challenge implies full and unconditional acceptance of the terms and conditions of these rules. Failure to comply with the conditions set out below will result in the nullity of the participation.
Participation in the Challenge is open to any natural person (hereinafter « Participants ») who:

  • Is at least 18 years of age and has full legal capacity;
  • Owns a smartphone compatible with the Seanapps mobile application;
  • Has created an active owner account on the Seanapps mobile application and has accepted the application’s general terms of use;
  • Is the owner of an Excess brand boat.

Participation via an owner account – case of guest users
Participation in the Challenge is exclusively linked to an active owner account on the Seanapps mobile application. Only one participation per owner account may be registered, regardless of the number of users sailing on board the boat concerned.
The Seanapps application distinguishes between two types of user profiles:

  • The owner account: account holder and the only person entitled to register for the Challenge;
  • Guest accounts: third-party users who can access the application via the owner’s invitation.

Only the holder of the owner account may register for the Challenge, accept these rules and claim a prize. By registering for the Challenge, the owner expressly acknowledges and accepts that navigation data produced during sailing by guest users – during the duration of the Challenge – shall be fully attributed to their owner account and used for the calculation of their ranking.

ARTICLE 4. TERMS OF PARTICIPATION

To access the Challenge, the Participant must:

  • Log in to their active owner account on the Seanapps mobile application;
  • Accept the terms of these Challenge rules (by ticking the box provided for this purpose) and the associated Personal Data Protection policy;
  • Authorise the application to collect the data necessary for monitoring the Challenge (navigation data);
  • Complete the challenge proposed during the Challenge period: Highest speed recorded on a trip.

Only one participation per person holding an owner account on the Seanapps mobile application will be taken into account. It is strictly forbidden for a Participant to enter with multiple email addresses. The information and contact details provided by the Participant must be valid and accurate, failing which the Participant may be excluded from the Challenge and, where applicable, lose their status as a Winner.
Participation in the Challenge is possible from Wednesday 1 July 2026 at 00:01 until Saturday 15 August 2026 at 23:59 (Paris time, UTC +2). This time is the sole applicable reference, regardless of the Participant’s geographical location.

ARTICLE 5. DETERMINATION OF WINNERS

Winners will be designated according to the following objective criteria: Highest speed recorded on a trip.
A ranking of Winners (« Winner ») will be established at the end of the Challenge.
Winners will be the participants who have achieved the best results in accordance with the criteria defined above. No draw is involved in the designation of Winners.
In the event of a perfect tie between several participants, the Winner will be the one who first achieved the performance.
During the Challenge period, an intermediate ranking is visible to all participants via the Seanapps application. This ranking displays the pseudonym, the boat model, the maximum speed recorded, the duration and, where applicable, the profile picture associated with the Participant’s owner account. By registering for the Challenge, the Participant expressly authorises the publication of these elements in the ranking accessible to other participants.
Winners will be contacted by the Organiser by email to confirm prize collection arrangements.
If a Winner does not come forward within thirty (30) days of notification, they will be deemed to have renounced their prize, which will not be awarded and will be retained by the Organiser.
Any Winner who fails to come forward within the above-mentioned deadline from the date of dispatch of the notification will forfeit their right to the prize, without any liability being incurred by the Organiser.
Participants authorise all verifications relating to their identity, age, postal address or the fairness and accuracy of their participation. Any false declaration, false identity or address will result in the immediate elimination of the Participant and, where applicable, the return of any prize already received.
It is strictly forbidden, by any means whatsoever, to modify or attempt to modify the Challenge systems proposed, in particular in order to alter the results or to influence, by automated or unfair means, the designation of a Winner. If it transpires that a Participant has apparently won a prize in breach of these rules, by fraudulent means, the prize concerned will not be awarded to them and will remain the property of the Organiser, or may be awarded to another Participant at the Organiser’s discretion.

ARTICLE 6. PRIZES

The Challenge comprises three (3) prizes. Only one prize will be awarded per Winner.
Subject to compliance with the terms of these Challenge rules and under the conditions set out therein, the Challenge gives Participants the opportunity to win the prizes defined below:

Each Winner is solely responsible for the payment of any taxes, duties, social charges or other costs that may be applicable in their country in connection with the receipt or use of the prize. The Organiser shall bear no liability in this regard.
It is specified that the value indicated for each prize corresponds to the public price generally applied or estimated at the date of drafting these Challenge rules. It is given for information purposes only and may be subject to variations.
The Organiser reserves the right to replace any prize with a prize of equivalent value, in particular in the event of unavailability of the originally planned prize. The prize may not give rise, on the part of the Winner, to any contestation, nor to payment of its cash equivalent, nor to its replacement or exchange for any reason whatsoever, including in the event of loss or theft.
The prize will be handed to the Winner on-site, upon their participation in the Excess Factory Tour 2027. No home delivery will be made.

ARTICLE 7. PARTICIPATION COSTS

Any participation costs of whatever nature (postage costs, internet connection costs) will not be reimbursed by the Organiser.

ARTICLE 8. PERSONAL DATA PROTECTION

In the context of this Challenge, the Organiser, acting as data controller, processes certain personal data relating to Participants, such as: first name, surname, pseudonym, profile picture, email address, trip, distance, speed and postal address (hereinafter collectively referred to as « Personal Data »).
The Personal Data processed is necessary for the performance of the contract between the Participant and the Organiser arising from their participation in the Challenge. It is processed for the purposes of organising the Challenge, managing Participants’ entries (in particular for performance monitoring, ranking compilation, prize delivery and the handling of any claims from one or more Participants). Participants are reminded that the information requested is essential for organising the Challenge and receiving the prize. Failing this, the Organiser would be unable to process the participation, the ranking, and to deliver the prize in the event of a win.
In any event, all Personal Data of Participants collected in the context of participation in the Challenge will be retained for the period necessary for their participation in the Challenge and, where applicable, for the management of the prize, and for the applicable limitation periods, then deleted.
In accordance with applicable French regulations on personal data protection and privacy, each Participant has the right to access, rectify and delete their Personal Data, and in certain circumstances, the right to request restriction of processing, portability of their personal data, and to object to the processing of their data by the Organiser. Each Participant also has the right to provide instructions regarding the processing of their Personal Data in the event of death.

ARTICLE 9. LIABILITY

The Organiser shall not be held liable for:

  • Malfunctions that may affect access to and/or the proper conduct of the Challenge, in particular due to external malicious acts;
  • Technical problems that may affect participation in the Challenge or the receipt of results;
  • Any errors in the information provided by Participants;
  • Any delay, loss, theft or damage affecting the prize;
  • Any incidents that may occur in connection with the enjoyment of the awarded prize and/or its use and/or its consequences.

The Organiser reserves the right, if circumstances so require, to shorten, extend, interrupt, modify, defer or cancel the Challenge, without incurring any liability.
The Organiser reserves the right to cancel the Challenge if it becomes apparent that fraud has occurred in any form in connection with participation in the Challenge or in the determination of the Winner. The Organiser also reserves the right to disqualify any Participant in the event of fraud, attempted cheating or unethical behaviour.
The Organiser cannot be held liable for the delivery of a prize to an incorrect address due to the transmission of erroneous information by the Winner.

ARTICLE 10. CLAIMS

Any claim or request for information relating to the Challenge must be submitted in writing and sent by email to contact@seanapps.fr within 45 days of the end of the Challenge. After this deadline, no claim will be accepted.

ARTICLE 11. APPLICABLE LAW

These rules are governed by French law. The French version shall prevail in the event of a dispute, regardless of the language in which the rules were consulted by the Participant.
Any dispute relating to their interpretation or application shall be brought before the competent courts of the Organiser’s jurisdiction.
